Quitaro Terms of Service

Effective date: October 1, 2026

These Terms govern the Quitaro Android app and related services (the “Service”) provided by 4etverg LLC (“4etverg,” “we,” or “us”). By using the Service, you agree to these Terms. If you do not agree, do not use it. You must be at least 18 and legally able to enter this agreement.

1. What Quitaro is

Quitaro is a habit-support and educational product. It is not medical care, a smoking-cessation treatment, or a promise of any health outcome. Seek a qualified clinician for medical advice, withdrawal concerns, or urgent symptoms.

Quitaro is not a medical device and does not diagnose, treat, cure, or prevent any medical condition.

Quitaro provides three free days. After that, continued access requires one one-time in-app purchase selected from the tier nearest the monthly cigarette-spend estimate you enter: $25, $50, $75, or $100, or $150. A separate $5 product may be used for an internal pilot and is not offered to ordinary users. The purchase is a license for access to Quitaro features; it is not a deposit, contribution, donation, investment, or tax-deductible payment. Google Play processes the transaction and may impose its own terms, billing rules, and fees. There is no subscription and no automatic renewal.

2. Honest check-ins and restarting

During a run, you may be asked to make one honest daily check-in. A run restarts if you report a relapse or accumulate more than three missed required check-ins. A restart changes the run and progress state only; it does not cancel, reverse, or refund a completed purchase. Quitaro does not independently verify check-ins and does not guarantee abstinence. The purchase remains paid except where a refund is required by law or Google Play policy.

3. Friend entry

A paying user who holds a complete 60-day run may receive one friend invite code. The code is single-use, expires 30 days after issuance, is non-transferable, has no cash value, and may not be sold, exchanged, duplicated, automated, or used commercially. The invited friend may redeem it for free Quitaro access. We may decline or cancel an entry obtained through abuse, fraud, or technical error. Eligibility, platform, geographic, and other limits shown when the code is issued also apply.

4. 4etverg charitable giving

4etverg’s company policy is to give 70% of its net Quitaro proceeds, after Google Play’s fee, to US organizations recognized as section 501(c)(3) charities whose programs support lung-cancer research. 4etverg reports this giving quarterly. You are not the donor: you do not select or direct a recipient, receive a donation receipt or tax deduction, or obtain a third-party beneficiary right. Your purchase is not a donation, and no part of it is held for you or on your behalf. Giving depends on 4etverg’s accounting, recipient availability, and applicable law.

5. Billing, cancellation, and refunds

The one-time purchase is made through Google Play. We do not promise refunds except where required by applicable law or Google Play’s then-current refund policy. Requests should be made through Google Play’s purchase support flow. Deleting the app, restarting a run, or not using the Service does not itself create a refund right. We may discontinue or materially change features, subject to applicable law.

6. Privacy and analytics

Our Privacy Policy and Consumer Health Data Notice explain how we handle information. Optional product analytics use PostHog only after your affirmative in-app consent. If you decline, core access is not conditioned on analytics consent. Google Play may process purchase and device information under its own policies.

7. Ownership and acceptable use

4etverg and its licensors own the Service, software, text, marks, and other content. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Do not copy, resell, reverse engineer, interfere with, scrape, automate, impersonate, or use the Service unlawfully. You are responsible for the accuracy of your check-ins and information.

8. Disclaimers and limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES NOT EXPRESSLY REQUIRED BY LAW, INCLUDING WARRANTIES OF FITNESS, AVAILABILITY, AND PARTICULAR RESULTS. WE ARE NOT RESPONSIBLE FOR MEDICAL OUTCOMES, PROGRESS UNAVAILABLE BECAUSE OF DEVICE OR MISSING DATA, OR GOOGLE PLAY’S SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 4ETVERG WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where prohibited by law.

9. Governing law and contact

New Mexico law governs these Terms, without regard to conflict-of-law rules, except to the extent consumer law requires otherwise. Any permitted court proceeding must be brought in a state or federal court located in New Mexico, unless applicable law gives you another forum. Before filing a claim, please contact support@4etverg.com so we can try to resolve it.

We may update these Terms by posting a revised version and changing the effective date. Continued use after the effective date means you accept the revised Terms. If a provision is unenforceable, the rest remains in effect. These Terms are the entire agreement about the Service, except for policies expressly incorporated here.
